    FDA Rescinds Marketing Denial Order for Fumizer’s 
    Twist E-Liquids Products

     

    Fumizer LLC, the manufacturer of Twist E-Liquids vapor products, recently received notice that the Food and Drug Administration (FDA) rescinded its September 9, 2021 Marketing Denial Order for certain flavored vapor products with pending Premarket Tobacco Product Applications (PMTA). The rescission noted that upon further review the FDA found relevant information that was not adequately assessed previously. Therefore, Twist E-liquids’ products have been placed back into the review process, and will continue to be marketed while they remain under review.

     

    Twist E-liquids continues to support this multi-year process, since it is important that quality e-liquids remain available for consumers while restricting access to minors. This exciting next step in the PMTA review process allows Twist E-liquids to continue producing and distributing its line of freebase and salt flavors to distributors and retailers domestically and worldwide.

    Is there a difference between synthetic and “tobacco-free?”

    From our previous post about “What is Tobacco Free Nicotine?,” synthetic nicotine products are not alone in their prominent marketing as “tobacco-free” products. Products that are promoted as tobacco-leaf free or “extracted from tobacco” include Veloon!, RogueZyn, and Lucy. These products are not synthetic because they use nicotine derived from tobacco, but they are marketed similarly, including with claims like “clean” and “pure,” which may be misleading to consumers.

    Both types of products are marketed as “tobacco-free” because they don’t contain any tobacco leaf and even though these products may not look all that different, there are important regulatory differences between tobacco-derived nicotine products and synthetic nicotine products.

    Oral nicotine pouches, whether synthetic or tobacco-derived, are growing in popularity.  According to Nielsen data reported in an industry news article, dollar sales in convenience stores of nicotine pouches increased 470% in the first half of 2020. These new synthetic nicotine pouches could build off that market growth.

    How are non-tobacco products like TFN regulated?

    As highlighted in our previous post, “What is TFN (Tobacco Free Nicotine)?,” it is nicotine which is not derived from the tobacco plant.

    Although the U.S. Food & Drug Administration (FDA) has not made a decision on how it will regulate synthetic nicotine products, non-tobacco products like TFN have raised questions on whether they should be regulated as tobacco products or drugs.

    To date, the FDA regulates all nicotine products and different regulatory schemes apply depending on where the nicotine came from. For example, the Center for Tobacco Products reviews products containing tobacco or tobacco-derived nicotine. Meanwhile, nicotine products that aren’t derived from tobacco are generally considered drugs and would typically go through the Center for Drug Evaluation and Research group for approval and review for safety and effectiveness.

    Until a decision by the FDA is made on how to regulate these products, synthetic nicotine products remain on the market.

    Vape Companies Face New Shipping Challenges in 2021

    Congress Amends the PACT Act to Apply to All Vaping Products, Placing Huge Burden on Small Manufacturers as Third-Party Common Carriers Refuse to Ship Products

    Twist E-liquids is committed to providing its audience the latest news and information about issues that affect vaping and the community. In 2020, the PACT Act was signed into law in the U.S. and it has major implications on how vaping companies and consumers will be able to distribute and receive their beloved flavors.

     

    Background

    As part of the “Consolidated Appropriations Act, 2021,” in the most recent COVID-19 relief bill signed into law on December 27, 2020 during the Trump administration, Congress amended the Prevent All Cigarette Trafficking (“PACT”) Act to apply to e-cigarettes and ALL vaping products. Key takeaways:

    • It will require interstate shippers to report cigarette sales to state tobacco tax administrators in order to combat illicit sales and tax avoidance.
    • The PACT Act also requires sellers to file a monthly report with the state tobacco tax administrator and any other local or tribal entity that taxes the sale of cigarettes.
    • The PACT Act also prohibits the use of the U.S. Postal Service (“USPS”) to deliver cigarettes and smokeless tobacco products directly to consumers.
    • The Postal Service has not yet published any clarifying regulations in this regard, but companies should anticipate the mail ban going into effect on or about April 27, 2021.

    The PACT Act has historically exempted businesses-to-business deliveries from the USPS ban. Companies seeking to use USPS for business-to-business deliveries must first submit an application to the USPS Pricing and Classification Service Center and comply with several other shipping, labeling, and delivery requirements. The Postal Service’s yet-to-be-published clarifying regulations could address whether business-to-business deliveries will remain permitted for consumers.

     

    Additional Threats

    Critically for the vapor industry, the most commonly used carriers, Federal Express and United Parcel Service (UPS), have recently announced that they would cease all deliveries of vapor products. According to Vaping360, as of March 1, 2021, FedEx will begin prohibiting “electronic cigarettes, vaping liquids, and other vaping products in the FedEx global network.” A UPS spokesperson also told Vaping360 that, effective April 5, 2021, “UPS will not transport vaping products to, from, or within the United States due to the increased complexity to ship those products.”

     

    Key Dates

    • FedEx to Stop Shipping Vapes by March 1, 2021 
    • UPS to End Vape Delivery by April 5, 2021
    • USPS to End Vape Shipping by April 27, 2021

     

    Takeaway

    Without effective delivery options, PACT Act compliance becomes moot. Twist E-liquids is one of the many vapor businesses, which are exploring arrangements with private logistics and transportation companies, as well as expensive software solutions to help comply with the PACT Act requirements.     Although the federal and state governments have mostly negative opinions about vaping, luckily there are a few politicians who actually support the vape industry. 

     

    FL Governor Rick Desantis

    In September 2020, Governor Ron Desantis of Florida vetoed a bill that would have effectively banned flavored vaping products in the state of Florida. Desantis is on record calling vaping a “reduced-risk alternative” to cigarettes, and also stated that taking away the safer option would more than likely influence people to return to regular cigarettes. The biggest goal has been to prevent underage use, but this would not be achieved by eliminating legal products for adults, and hurting small businesses in the process. Concerns were also raised that the ban would push more people towards black market sales, which would prove to achieve the opposite effect of what the ban had intended.

     

    IA Governor Kim Reynolds

    In Iowa, there have been no restrictions on vaping as of yet. Governor Kim Reynolds stated that she had already ruled out an executive order that would ban vaping products in the state; citing that educational efforts had been working in keeping people informed on the pros and cons of vaping. The governor told reporters that Iowa had 43 cases of VAPI (Vaping Associated Pulmonary Injury) and of those, 34 were associated with illegal street-market cannabis vape cartridges. The state of Iowa has made it a point to keep its citizens educated on the potential health risks of vaping, and letting them decide how they want to proceed. 

     

    NE Governor Pete Ricketts

    As of 2020, the state of Nebraska had proposed a flavour ban based on the premise that flavoured tobacco was influencing minors to vape. However, it was not passed due to new data released by the CDC that has indicated that Curiosity, rather than flavors, is what mostly drives kids to pick up vaping. Among students who reported ever having tried e-cigarettes, the three most common reasons for use were “I was curious about them” (55.3%), “friend or family member used them” (30.8%), and “they are available in flavors, such as mint, candy, fruit, or chocolate” (22.4%). Although Governor Ricketts has pursued raising the vaping age to 21 in the state, there have been no further plans to ban flavors or vaping in general.

    According to vapingpost.com, the two presidential candidates may have vastly different views on a wide range of topics, but they actually share a common view on vaping. It seems both candidates have taken the stance of blaming vaping for the increase in Tobacco usage among Youths.

     

    President Trump’s Point-of-View

    As president, Trump has appointed several regulatory leaders that have taken the anti-vaping stance, including opposing tobacco harm reduction. Scott Gottileb, the former FDA Commissioner who was appointed by Trump, declared youth vaping a public health epidemic. But he’s not the only one;  Surgeon General Jerome Adams, another Trump appointee, gained attention for falsely comparing vaping to heroin use. He is also expected to ban most vaping flavors nationwide.

     

    Former VP Biden’s Point-of-View

    Most would think that the candidate from the opposing party would hold a more progressive view on this topic, but that’s not exactly the case here.  Biden has stated that should he win the presidency he intends to ban vaping in the US. The presidential candidate has accused the vaping industry of criminal acts, and has called for the halt of sales of vaping products until more research about their effects are conducted. Biden has proposed even tighter restrictions than the Trump administration’s partial ban on the sale of flavored products.

    Vape Responsibly Series 06 – Jacklynn Janos-Arquette

    As we continue to explore what it means to vape responsibly, we find ourselves having insightful conversations with vapers who have been able to quit smoking cigarettes thanks to vaping. Each of these conversations helps show us that although no one’s story is identical, there are always a few underlying commonalities. For instance, most of the vapers who have successfully switched over talk about having a moment where they clearly see why they need to make the switch.

    This week we spoke with Jacklynn Janos Arquette, a 31 year old vaper who is working on becoming an influencer in the hopes that she can help others quit smoking. Her passion and drive to help others quit smoking is a testament to the way the vape community actively tries to help people choose healthier alternatives to smoking combustible cigarettes. 

    Here is the conversation we had with Jacklynn, we hope you find it as informative as some of our other conversations about vaping responsibly:

     

    Q: What age did you start smoking cigarettes and how many did you smoke a week? 

    A: I started smoking at age 15, and yes I was very young, but it seemed like it was normal at the time and all my friends were also smoking! When I initially started smoking, a pack of cigarettes would probably last me about 3 days, but as I got older I’d smoke a pack a day. 

     

    Q: How did smoking cigarettes affect your life and those around you?

    A: I already had a lot of health problems to begin with, mainly to do with fertility and heart problems as well, and smoking cigarettes seemed to make them much worse for me. I was always out of breath and I struggled with migraines weekly! I was always feeling guilty and trying to cover up the stink, as well as worrying about my kids being exposed to secondhand smoke, even though I wasn’t smoking around them – It just gets in your pores and all your clothes!

     

    Q: How did you find vaping? What flavor helped you quit smoking?

    A: I had heard of vaping before, but I didn’t really know much about it. I began vaping as a more discrete way to get my nicotine fix while I was at work. As I continued vaping, I discovered that over time I wasn’t craving cigarettes as much anymore, and the less I smoked the better I felt overall. This made me want to learn more about vaping, so I dived into learning about it on YouTube, and as I continued to learn I made the decision that i wanted to quit smoking and be a better role model for my children and also improve my health overall. Fruity and dessert flavors were the key things that helped me quit smoking. Specifically, Pink Punch Lemonade was my go to!

     

    Q: How did vaping make you feel as opposed to cigarettes?

    A: My life is honestly so much better without cigarettes! I can’t stress that enough. Like I said, I feel free from always feeling guilty about smoking, and trying to cover up the stink. I can breathe better and my taste buds feel amazing now, I feel like I can taste everything better!

     

    Q: Do you have any advice to those that are currently cigarette smokers and want to make the switch?

    A: Quitting is hard, but for anyone thinking about it, I promise that making the switch is truly worth it. It benefits not only your health, but that of everyone around you! I can also tell you that the vaping community is extremely supportive and you won’t be alone on your journey. If one device or flavor doesn’t work for you, just keep trying others until you find the perfect match. I also suggest starting with nicotine salts until you gradually wean yourself off of cigarettes and then you can work yourself down to the less concentrated freebase e-liquids!
